Process

Our H-1B workflow.

  1. Retainer. We evaluate the role and confirm specialty-occupation classification.
  2. LCA. Employer files the Labor Condition Application with DOL; we prepare the public access file.
  3. Posting. Notice of the H-1B position is posted at the worksite for 10 days.
  4. Petition. Form I-129 filed with USCIS (April 1 for cap-subject; any time for cap-exempt).
  5. Adjudication. Approval notice (I-797) issued; we respond to any RFEs.
  6. Activation. Consular processing abroad or in-country status adjustment.

What are the filing fees?

$460 (I-129), plus $750–$1,500 ACWIA fee, $500 fraud prevention, and an optional $1,440 premium processing.

What happens if my petition is selected in the lottery?

The sponsoring employer files the full I-129 petition package by the USCIS window. We handle all documentation and employer-side compliance.

Can I change employers on H-1B?

Yes — via H-1B transfer (portability). You can start the new job as soon as we file.

What if I get an RFE?

We respond with comprehensive evidence within the USCIS deadline. Most RFEs we see involve specialty occupation or wage level challenges.
